Welcome to Cubicle Kitchens ("Cubicle Kitchens," "we," "us," or "our"), a catering and delivery marketplace that connects customers with local restaurants and independent delivery drivers. By accessing or using any part of our services - including our website, mobile app, and other platforms - you agree to be bound by these Terms and Conditions.
These Terms apply to all users, including restaurant partners, customers, and delivery drivers. By continuing to use our services, you acknowledge that you have read, understood, and accepted all terms outlined below.
You must be at least 18 years of age and capable of entering into a legally binding agreement to use Cubicle Kitchens. We reserve the right to verify your eligibility and may refuse access or service at our sole discretion.
Cubicle Kitchens operates solely as a technology platform that facilitates food ordering and delivery. We do not prepare food, operate restaurants, or employ delivery drivers. All food preparation and deliveries are performed by independent third parties who use the platform to connect with customers.
Restaurant partners agree to provide accurate information about their business, menus, and availability. They are responsible for compliance with all applicable health, safety, licensing, and tax laws. Any violation, misrepresentation, or customer complaint may result in suspension or removal from the platform.
Drivers who use our platform must maintain valid driver’s licenses, insurance, and required permits. Drivers are classified as independent contractors, not employees of Cubicle Kitchens. Drivers are responsible for completing deliveries safely, on time, and in a professional manner.
Customers are expected to provide accurate delivery information and make prompt payments. They understand that food is prepared by independent restaurants and delivered by third-party drivers, not Cubicle Kitchens employees. Orders may be refused, delayed, or canceled under certain conditions, including health or safety concerns.
All users agree to the pricing displayed at checkout, which may include food costs, delivery fees, taxes, service fees, and optional tips. Restaurants are paid based on agreed terms, and drivers receive compensation per delivery completed. Cubicle Kitchens may revise its fee structure at any time, with or without notice, and such updates will be reflected on the platform.
Cubicle Kitchens reserves the right to refuse service to any user, at any time, for any reason. This includes, but is not limited to, suspected fraud, abusive behavior, platform misuse, safety risks, or violation of these Terms. Such refusal may occur with or without prior notice.
Users are responsible for safeguarding their login credentials and ensuring that their use of the platform complies with applicable laws. Reverse engineering, scraping, unauthorized data extraction, or other misuse of the system is strictly prohibited. Accounts suspected of violating these Terms may be suspended or terminated.
Orders may be canceled within the cancellation window displayed at the time of checkout. Refunds will be handled on a case-by-case basis, in line with restaurant and platform policies. Drivers and restaurants are not liable for delays caused by incorrect addresses, unavailability, or unforeseen events.
Cubicle Kitchens disclaims all liability for the acts, errors, or omissions of independent restaurants and drivers. We do not guarantee uninterrupted or error-free access to the platform. In no event shall Cubicle Kitchens' total liability exceed the lesser of $100 or the amount of the transaction in question. We are not responsible for food-related issues, delivery delays, or lost items.
All disputes, claims, or legal actions arising from the use of our services shall be governed by the laws of the State of California. Any legal proceedings must be brought in Los Angeles County, California. Users waive any right to participate in class actions and agree to resolve matters individually. In cases permitted by law, arbitration may be used to resolve disputes.
We may terminate or suspend any account at our discretion, without liability, and without notice if we determine a violation of these Terms or any risk to the integrity of the platform. Users may request to close their account at any time by contacting us.
Cubicle Kitchens reserves the right to modify these Terms and Conditions at any time. Changes will become effective upon posting to the platform. Continued use after updates constitutes acceptance of the revised terms.
All users are expected to comply with applicable California laws, including but not limited to health codes, labor regulations, consumer protection, and data privacy laws such as the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). These Terms are written and interpreted in a manner favorable to Cubicle Kitchens as a marketplace operator.
